Uzbekistan Establishes Agency for Intellectual Property

On May 24, 2011, Uzbekistan’s president signed a decree establishing the Agency for Intellectual Property of Uzbekistan. The cabinet of ministers signed a detailed enactment on June 8, 2011, according to which the two previous intellectual property offices, the State Patent Office of the Republic of Uzbekistan and the Uzbek Republican Agency for Copyright, ceased to exist.

This newly formed agency has consolidated the two offices, accepted their responsibilities and will ensure the implementation of the single state policy on protection of intellectual property. The agency will also provide education in the field of intellectual property protection for its employees and will represent Uzbekistan at the World Intellectual Property Organization and other IP organizations.

Uzbekistan SPO Announces Changes in Patent Fee Payment in National Currency

Uzbekistan State Patent Office (SPO) has recently announced changes in the bank account information for the payment of patent fees and other services in national currency, applicable as of January 1, 2011.

The new bank account details related to the payment of fees are posted on the SPO website.

Uzbekistan SPO Announces New Bank Details for Patent Fee Payment

Uzbekistan State Patent Office (SPO) has recently announced changes in the payment of patent fees and other services due to the change of the servicing bank.

The new bank details are posted on the SPO website and are applicable as of June 1, 2010.

Uzbekistan Extensions for Office Action Replies Shortened to Three Months

The Uzbekistan PTO has made an official announcement on its website about the change in the procedure for prosecution of national trademark applications.

In Uzbekistan, responses to office actions must be dated and submitted within three months from the mailing date of the office actions. Extensions are possible but as of December 2009 have been shortened from six months to three months. The official fee for an extension is USD 84 (EUR 58) per each month of extension.

With respect to international trademark registrations, there have been no changes in the procedure. The responses to office actions must be dated and submitted within six months from the mailing date of the office action, while the maximum period of deadline extension is still six months. The official fee per each month of extension is USD 53 (EUR 36).

New regulations and official fees for patent annuities in Uzbekistan

The Uzbekistan Patent Office recently announced changes in the payment of patent annuities, as well as new official fees, effective immediately.

Under the new rules, annuities are still due only after a patent has been granted, but the tax base date will be the patent filing date, (or the international filing date, in cases of the national phase of a PCT application) rather than the patent grant date.

In addition, annuities must now be paid annually until the end of the 20th year of validity, rather than ending after the 11th year.

This new practice will apply to new and existing patents. As a transition, existing rights holders must pay a fee for the period between the date on which their patents were maintained previously and the next anniversary date of their patents, calculated from the filing date. If this period is less than six months, the official annuity fee will be reduced (only after examination by the Patent Office). If this period is more than six months, the fee for a complete year must be paid.

Subsequently, annuities will be due before each anniversary of the patent, calculated from the filing date.

Denunciation of Madrid Agreement by Uzbekistan

On January 3, 2007, the Republic of Uzbekistan deposited its instrument of denunciation of the Madrid Agreement with WIPO. This denunciation shall take effect on January 1, 2008.

Article 15 of the Madrid Agreement prescribes the possibilities for a member state to denounce the Agreement, and the consequences thereof.

International marks registered up to the date when denunciation becomes effective (i.e. January 1, 2008 for the Republic of Uzbekistan), and not refused within a period of one year from this date, shall continue, throughout the period of international protection, to enjoy the same protection as if they had been filed directly in the denouncing country.

Therefore, it is still possible to designate Uzbekistan through the Madrid Agreement during the period from January 3, 2007 (deposit of the instrument of denunciation) to January 1, 2008 (the effective date of denunciation), and such designation shall be treated “ordinary” (i.e. registered and/or refused within one year as anticipated in Article 5 of the Madrid Agreement).

The Madrid Protocol will enter into force with respect to Uzbekistan on December 27, 2006

Like most member countries, it has chosen 18 months as the period for automatic protection.

The accession to the Madrid Protocol by Uzbekistan brings the number of members of the Protocol to 70.
