Change in Individual Fee under Hague Agreement for Kyrgyzstan

The new, lower, individual fee prescribed by the Hague Agreement for international industrial design applications designating Kyrgyzstan will enter into force on August 1, 2011.

As of August 1, international industrial design applications designating Kyrgyzstan will cost CHF 129 (EUR 110; USD 154) for one design and CHF 64 (EUR 55; USD 78) for each additional design, instead of CHF 156 (EUR 135; USD 199) and CHF 78 (EUR 67; USD 95), which are the current costs.

The industrial design renewals designating Kyrgyzstan will cost CHF 64 (EUR 55; USD 78) for one design, while each additional design renewal will cost CHF 6 (EUR 5; USD 7), instead of the current CHF 78 (EUR 67; USD 95) and CHF 8 (EUR 7; USD 10). The Hague Agreement, administered by the World Intellectual Property Organization (WIPO), regulates the international registration of industrial designs.

WIPO: Kyrgyzstan Leader in IP in Central Asia

Kyrgyzstan is the only country in Central Asia with a well-developed intellectual property protection strategy, stated Saule Tlevlessova, WIPO’s representative from the Division for Certain Countries in Europe and Asia, during a seminar on copyright and related rights in Kyrgyzstan, on March 1, 2011.

Tlevlessova emphasized that statistics provided by international organizations show that piracy and copyright infringement are at a much lower level in Kyrgyzstan than in the other former Soviet countries including Russia, Belarus, Kazakhstan, Ukraine and Uzbekistan.

Kyrgyzstan Accedes to Hague Convention Abolishing the Requirement for Legalization for Foreign Public Documents

In November 2009, the Kyrgyz parliament adopted the Law on the Accession to the Hague Convention of 5 October 1961 Abolishing the Requirement for Legalization for Foreign Public Documents. In June 2010, the Kyrgyz government issued a number of by-laws regarding the implementation of the Convention. According to the Kyrgyz Ministry of Justice, the Convention is expected to become effective as regards relations between Kyrgyzstan and other parties to the Convention in February 2011.

Under this convention, an official public document issued in one of the signatory countries can be certified in the country of issuance and become valid in all other signatory countries without further diplomatic or consular legalization.

Kyrgyzstan Leader in Harmonizing National with International IP Standards

On March 3, 2010, during a meeting with the Kyrgyz delegation, Mr. Michal Svantner, WIPO’s senior counselor from the Division for Certain Countries in Europe and Asia, said that the Kyrgyz IP legislation is one of the most progressive in the former Soviet Union.

Both Kyrgyz and WIPO representatives agreed that Kyrgyzstan has evolved in terms of intellectual property in recent years. “We are just beginning to get rid of stereotypes of the Soviet past, when everything belonged to the state, and the word ‘property’ was of a negative sense,” Ulan Melisbek, head of the Kyrgyz IP office noted.

In 2009, the parliament and Kyrgyz IPO did much work on refining the intellectual property legislation and establishing the national IP strategy which WIPO is helping implement.

Kyrgyzstan Patent Applications for Inventions Increase in 2009

According to the official statistics of the Kyrgyz PTO, the number of patent applications for inventions increased by 7.3 percent in 2009 in comparison to 2008. The PTO received 149 patent applications last year, out of which 87 have been recorded in the state registry of inventions.

The most popular areas for inventions were mechanics, chemistry, weapons, electricity, fabrics and technology. From 1993 to 2009, a total of 3,588 patents for inventions were registered in Kyrgyzstan.

Kyrgyzstan Selected Regional Coordinator of WIPO

Kyrgyzstan has been selected as the regional coordinator of the World Intellectual Property Organization (WIPO), thus replacing the Russian Federation in this position.

The region Kyrgyzstan is to be responsible for includes the Russian Federation, Belarus, Ukraine, Tajikistan, Kazakhstan, Armenia, Turkmenistan, Azerbaijan and Uzbekistan.

The decision was made at the meeting of WIPO member states, held from September 22 to October 1, 2009 in Geneva, Switzerland.

There are seven regional groups in the WIPO. Coordinators are responsible for facilitating the relations between the WIPO Secretariat and the member states. They are also responsible for the representation of their groups during the meetings with the Secretariat and the dissemination of information afterwards.

Serbia is now a regional coordinator of the Central European and Baltic States.

Kyrgyz Domain Registry Website Launched

Kyrgyz PTO recently launched a KG Domain registry website. Many pages seem to be under construction. However, it is possible to search for available domain names. It is not possible to apply for a domain name online.

Kyrgyzstan to Set up Administration Center for “KG” Domain

On July 29, 2009, Kyrgyz Prime Minister Igor Chudinov signed a resolution that stipulates establishment of an administration center for the national “KG” domain.

According to this resolution, the administration center will operate under and will be funded by the Kyrgyz PTO. It will comprise eleven staff members of the Kyrgyz PTO.

In the next two months, the Kyrgyz PTO is planning to submit for government’s approval a draft regulation for the administration.

The implementation of the resolution will be supervised by the Kyrgyz Department of Education, Culture and Sport.

Kyrgyz PTO Organizes Anti-Piracy Action

On June 19, 2009, the Kyrgyz Patent Office organized a public destruction of 20,000 pirated CDs and DVDs as part of its “Combat against Piracy” action.

The value of destroyed CDs and DVDs amounts to approximately EUR 16,492 (USD 23,202).

More than 2,000 people participated in the action, and were able to win 1,500 original CDs by exchanging them for pirated ones and by taking part in various competitions and quizzes.

The action, which took place in the capital city of Bishkek, was organized jointly with the City Hall, the Financial Police and the Court Department.

The action was supported by representatives of creative unions, such as the Filmmaker’s Union and the Composer’s Union, as well as by more than 20 local music stars.

WIPO Holds Regional Forum for University IP Coordinators in Kyrgyzstan

The World Intellectual Property Organization (WIPO) organized a regional forum for university intellectual property (IP) coordinators in Cholpon-Ata, Kyrgyzstan, from July 14 to July 16, 2009.

The forum was held in cooperation with the Kyrgyz Patent Office and it addressed the following issues:

  1. IP policy and key issues for universities and research and development institutions;
  2. University IP and technology management in former USSR republics;
  3. Innovations and technology transfer capacity building.

The event was attended by WIPO representatives, specialists from the patent offices of Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan and Uzbekistan.

Kyrgyz PTO and AsiaInfo Sign Agreement on Administration of “KG” Domain

As we reported in April (see here), the Kyrgyz government was getting ready to transfer administration of the “KG” top-level domain to the Kyrgyz IPO. The transfer was made official on June 10, 2009.

On that day, the Kyrgyz Patent and Trademark Office and a local communication company AsiaInfo signed the Protocol of Intentions according to which the administration of the ”KG” domain would be transferred from AsiaInfo to the Kyrgyz PTO.

The document was submitted to the Internet Corporation for Assigned Names and Numbers (ICANN) to confirm the transfer of administrative rights. The “KG” domain registry should be transferred to the Kyrgyz PTO no later than two months after ICANN’s decision.

The main motivation behind the transfer is to end AsiaInfo’s monopoly and to reduce the high domain registration fee, which slows the growth of national websites. The transfer should promote the development of a competitive market for Internet domain registrars in Kyrgyzstan, explained Farkhat Ibragimov from the International Relations Division of the Kyrgyz PTO.

AsiaInfo was the sole registrar of the “KG” domain for 14 years. It was granted this right by the Internet Corporation for Assigned Names and Numbers (ICANN) on July 12, 1995.

In the beginning of 2009 the Kyrgyz PTO and AsiaInfo negotiated a reduction of the one-year domain registration fee from USD 100 to USD 60, which still proved too high for many website owners.

Accordingly, on April 7, 2009, the Kyrgyz president issued a decree on the transfer of administration rights for the “KG” domain to the Kyrgyz PTO.

Ibragimov said that the Kyrgyz PTO would like to reduce the domain registration fee to USD 15-20.

Kyrgyz Patent Office to Administer National Domain “KG”

Kyrgyz President Kurmanbek Bakiev signed the decree on domain names, entitled “The Decree on the Arrangement of Functioning of the National System of Domain Names” on April 7, 2009.

The decree authorizes the Kyrgyz Intellectual Property Office to administer the national domain name “KG”. Prior to the decree, the domains were under the authority of the Kyrgyz government.

According to the decree, the Kyrgyz government will prepare an action plan to transfer administration of the “KG” top level domains to the Kyrgyz IPO, and will elaborate and introduce relevant draft enactments.

The decree will be enforced by the Division of Economic and Social Policy, and the Legal Policy Division of the Administration of the President of the Kyrgyz Republic.

The decree is expected to enter into force on the day of its publication in the Official Gazette.

Kyrgyzstan Awards First IP Protection Certificates

On March 20, 2009, the Kyrgyz Patent Office awarded its first IP protection certificates to police, customs and inspection officers upon their successful completion of a three-day training course entitled “The Protection of Intellectual Property Rights.”

According to the Kyrgyz Patent Office, the training was conducted following an initiative of the government’s Inter-agency Commission for the Prevention of Violations of Intellectual Property Rights.

The objective of the training was to raise awareness about the protection of intellectual property rights in order to strengthen enforcement efficiency and to prevent violations in this field.

The training is expected to be conducted on a monthly basis. The first alumni included representatives of the State Customs Committee, Financial Police and Judicial Department.
