Azerbaijan to Establish Electronic IP Rights Registration System
Azerbaijan has formed a special working group whose duty will be to establish an electronic system for registration of intellectual property rights.
The group will function within the frames of the Azerbaijani State Committee on Standardization, Metrology and Patents, and the project will be supported by the Korean government’s USD 4.2 million (EUR 3.2 million) grant.
The Azerbaijani State Committee on Standardization, Metrology and Patents signed the agreement with the Korean Foreign Affairs and Trade Ministry on October 11, 2011, with an aim to secure a stable IP registration system in Azerbaijan.

Azerbaijan to Establish Center for IP Rights
The Azerbaijani Cabinet of Ministers has decided to establish the Center for Intellectual Property Rights within the frames of the Azerbaijani Copyright Agency. This decision came into force on December 7, 2011.
The Center’s activities will be financed by the Ministry of Finance, while the State Committee for Property Affairs is responsible for securing premises for the Center within a month.

Azerbaijani Copyright Agency to Pay Royalties for Downloaded Music to Foreign Performers
The Copyright Agency of the Republic of Azerbaijan has signed contracts with a number of performers from neighboring countries for payment of royalties when their works or performances are downloaded from Azerbaijani websites.
The Agency has also called on songwriters, composers and performers whose work and performances are downloaded from the Internet, to submit their personal details and information about their work to the Agency. This information will be entered in a recently created database aimed at ensuring copyright protection in the digital environment.
The Agency is also holding talks with major Azerbaijani websites to secure their cooperation on this project.
“Foreign performers can connect with us as a relevant agency, either via the copyright and intellectual property protection agencies in their country or directly. We have signed a number of similar contracts directly with Russian artists who regularly get fees from us”, the agency noted.

Azerbaijani Scientists Develop Technology to Monitor Cardiovascular Disease via Mobile Phones
Scientists at the Cybernetics Institute of the Azerbaijan National Academy of Sciences have developed a technology to monitor via mobile phones the incubation period for pathological processes in the cardiovascular system.
Institute Director Telman Aliyev explained that the invention is based on the heart sound analysis and technology for monitoring the incubation period. A Eurasian patent has already been awarded for this invention and research results have been published in various journals.
“The monitoring will only tell people with cardiovascular problems that the process is starting. A doctor will make the diagnosis. It will not replace the doctor,” Aliyev cautioned.
Aliyev said that the institute did not hold any talks with mobile operators regarding this project, explaining that they want to demonstrate the invention first, most probably by November 2011. He also revealed that the United Kingdom, Spain and Poland have expressed interest in the project and offered partnership.
Aliyev noted that they expect this invention to become available to the public by the end of 2011.

Azerbaijani Government Signs Agreement With Microsoft to Use Licensed Software
The Azerbaijani government has signed an agreement with Microsoft promising to ensure that all government offices covered by the agreement are supplied with and are using genuine software, Microsoft Azerbaijan informed last month.
Azerbaijani Minister of Communications and Information Technologies Ali Abbasov noted that the agreement will help develop the information and communication technology in the country and raise awareness about security risks associated with using pirated software.
According to a piracy study released by the Business Software Alliance last month, Azerbaijan has one of the highest software piracy rates in the world, 88 percent.

3,740 Domain Names Registered in Azerbaijan in 2010
A total of 3,740 domain names have been registered in Azerbaijan since the beginning of this year, while the total number of domain names registered in this country so far is 10,696.
The majority of the domain names registered (9,734) are in the .az zone, followed by .com.az (550) and .edu.az (119).

Azerbaijan Accedes to Geneva Act
On September 8, 2010, Azerbaijan deposited its instrument of accession to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs, adopted in Geneva on July 2, 1999 (the Geneva Act).
The Geneva Act will enter into force in Azerbaijan on December 8, 2010. It allows users to apply for protection of industrial designs in the EU and other member states by filing one single application for registration.

Azerbaijan Issues Patents for 39 Inventions in Period April-August
The Azerbaijani State Committee for Standardization, Metrology and Patents issued patents for 39 inventions and seven industrial samples, and registered 764 trademarks in the period April-August 2010, the committee informed via an official statement.
Among the inventions patented are a method and instructions for sorting seeds in a liquid, a method for producing cooked sausages with vegetables, a drainage installation, a drying device, a foam maker for extinguishing fire, a method for producing acetone and a method for processing grapes.

Azerbaijan Opens Data Center Aimed at Facilitating Trade
The Azerbaijani State Committee for Standardization, Metrology and Patents opened a data center in Baku, the capital, on September 8, 2010 where producers, exporters and importers can apply for information on trade-related standards, technical rules and regulations in Azerbaijan and the World Trade Organization (WTO) member countries.
As the committee representatives explained, the establishing of this data center is in accordance with the Agreement on Technical Barriers to Trade, signed by Azerbaijan and the WTO, which aims to harmonize the Azerbaijani regulations on accreditation, standardization and metrology with international standards.

Majority of Azerbaijan Press Violate Copyrights
Only 30 percent of the Azerbaijani news portals write their own news stories, while the remaining 70 percent just copy them, Azerbaijani Copyright Agency Chairman Kamran Imanov stressed at a roundtable called “Copyright in the Mass Media: Problems and Ways of Solution”, held on May 14, 2010.
Imanov cautioned that just because the information in a certain news item is not copyrighted, it does not mean that the item can be used freely.
“In fact, the news is considered the right of the author if the information has the characteristic features, if it transforms into a creative product, and if it contains commentary and analysis,” he explained.
Imanov urged journalists, as champions of freedom of speech and freedom of press, to respect the copyright law, which protects “freedom and inviolability”.

New Rules on Patent and Industrial Design Extension in Azerbaijan
In order to implement the provisions of the Law amending the Law on Patents from December 21, 2009, the Cabinet of Ministers of Azerbaijan on April 12, 2010 approved the Rules on the extension of validity of patents and industrial designs.
The rules provide that the 20-year protection period for patents in the areas of pharmacology and agrochemistry can be extended for an additional period of up to five years if certain conditions are met. Namely, if a patent relates to a product or a method of manufacturing production, which requires obtaining an administrative authorization in accordance with the current legislation, the validity of a patent may be extended upon request of the patentee. In this case, patent validity may be extended for the period for which the administrative authorization is granted, provided that such period does not exceed five years.
In order to extend patent validity, the rights holder or his authorized representative is required to submit an application form, a copy of the document certifying the term (administrative authorization) and a Power of Attorney (if required).
With respect to industrial designs, the 10-year term of validity can also be extended for five additional years. For extension of industrial designs validity, the following documents should be submitted: an application for extension and the corresponding Power of Attorney (if required).
The new Rules also regulate the requirements regarding the payment of official fees.

USAID and Microsoft Unite in Fighting Software Piracy in Azerbaijan
The United States Agency for International Development (USAID) and Microsoft Azerbaijan signed on March 5, 2010 a Memorandum of Understanding uniting them in their efforts to fight software piracy in Azerbaijan.
USAID Caucasus Mission Director Jonathan M. Conly emphasized the significance of this alliance, stressing that the prevalence of illegal software in Azerbaijan puts businesses and consumers at risk. Conly explained that the first steps would be to train commercial bank auditors from the Central Bank of Azerbaijan to detect use of unlicensed software in banks and businesses nationwide.
Head of Microsoft Azerbaijan Teymur Akhundov noted that the alliance’s objective is to cut the use of pirated software by 10 percent.

Trademarks and Geographical Denominations Gazette Issued in Azerbaijan
The State Committee for Standardization, Metrology and Patents of Azerbaijan has recently started to issue the Official Gazette of Trademarks and Geographical Denominations.
The Committee stated that they receive thousands of applications for trademark registrations each year and that the Gazette will contain detailed information about each trademark.
